Terms of Service

1. Publisher and hosting

The Service is published by Derpinou, an individual acting in a personal capacity: this project is not incorporated as a company as of this document's date.

Contact: exclusively via the Service's official Discord support server (see the button at the bottom of this page).

Hosting: OVH SAS — 2 rue Kellermann, 59100 Roubaix, France — www.ovh.com.

2. Definitions

• “Service”: the Atom Discord bot and its dashboard, including all of its features (auto-moderation, anti-raid, XP, welcome messages, invite tracking, autorole, activity logs, etc.).
• “Server” or “Guild”: a Discord server on which the Service is installed.
• “Administrator”: any person holding administration rights on Discord for a Server and, as such, configuration access to the dashboard for that Server.
• “User” or “you”: any person using the Service, whether as a member of a Server where the bot is present or as an Administrator logged into the dashboard.
• “Premium”: the paid subscription offering described in Section 8.

3. Acceptance of these Terms

Using the Service (inviting the bot to a Server, logging into the dashboard, interacting with its commands) constitutes full acceptance of these Terms.

An Administrator who installs the Service on a Server warrants that they are entitled to do so and, where applicable, have obtained the consent of those responsible for that Server.

4. Description of the Service

Atom is a Discord bot, free to use in its base form, offering modules including: moderation and sanctions, anti-raid, automatic filtering (links, spam, caps, files), an experience (XP) and leveling system, welcome and goodbye messages, automatic role assignment, invite tracking, activity logs, and a web configuration dashboard.

The list of available features may change at any time, in particular during the Service's current beta phase.

5. Discord account and dashboard access

Using the Service requires a valid Discord account and compliance with Discord Inc.'s own Terms of Service and Community Guidelines.

The Service does not create or manage a separate account: logging into the dashboard is done exclusively through Discord authentication (OAuth2). You are solely responsible for keeping your Discord credentials confidential.

6. Minimum age

The Service is intended for people who meet the age requirements set by Discord Inc. for holding an account (13 or older, or any higher minimum age required in your country).

Each Administrator is responsible for ensuring that using the Service on their Server complies with the rules applicable to underage members of their community.

7. Acceptable use

You agree not to:

• use the Service for illegal or fraudulent purposes, or in a manner contrary to Discord's own Terms of Service;
• attempt to circumvent, disrupt or overload the Service (bypassing rate limits, exploiting vulnerabilities, denial of service);
• reverse-engineer or decompile the Service, except to the extent permitted by an applicable open-source license, if any;
• use the Service to collect data about Users without their knowledge or for purposes not covered by these Terms;
• resell, sublicense or commercially exploit the Service without prior written authorization.

Any breach may result in the suspension or termination of access to the Service, without prejudice to any further action.

8. Premium subscription

Principle — Premium is a paid subscription sold per Server, not per User: an Administrator with the necessary dashboard permissions can subscribe a given Server to Premium.

Payment — Payments are processed exclusively by our payment provider, Stripe. The Service never stores your full payment card details. The price shown at the time of subscription is the price actually due.

Renewal and cancellation — Premium renews automatically at each billing period until cancelled. Cancellation can be done at any time from the Stripe billing portal accessible from the dashboard; it takes effect at the end of the period already paid for, with no pro-rata refund, and Premium access remains active until that date.

Payment failure — If a payment fails, the subscription may be kept active temporarily while Stripe retries the charge; it is cancelled if those retries ultimately fail.

Right of withdrawal — Under Article L221-28, 13° of the French Consumer Code, the standard 14-day right of withdrawal does not apply to the supply of digital content not provided on a tangible medium once performance has begun with your prior express consent and your express waiver of that right. By subscribing to Premium, you expressly request immediate activation of the Service and acknowledge that you accordingly waive your right of withdrawal.

No refunds — Subject to mandatory legal provisions (in particular in the event the Service does not conform as described under Articles L224-25-12 et seq. of the French Consumer Code), no refund is owed for a subscription period that has already begun.

9. Availability and beta status

The Service, or some of its features, may be offered as a beta and may change, be modified or discontinued without notice.

The Service is provided “as is” and “as available,” without warranty of continuity, error-free operation, or uninterrupted availability. The Service's operational status can be checked on its public status page.

10. Intellectual property

The “Atom” name, logo and graphic elements of the Service are the property of its publisher and may not be reproduced without authorization.

The Service's source code may be distributed under a separate open-source license; where that is the case, the terms of that license govern use of the code, independently of these Terms, which govern use of the Service as provided to you.

11. Personal data

The processing of personal data carried out as part of the Service is described in our Privacy Policy, which forms an integral part of these Terms.

12. Limitation of liability

To the extent permitted by law, the publisher shall not be liable for indirect damages resulting from the use of, or inability to use, the Service, including loss of configuration data, service interruption, or an automated moderation action carried out in accordance with settings defined by an Administrator.

Nothing in these Terms excludes the publisher's liability for intentional misconduct or gross negligence, nor any mandatory statutory guarantees applicable to consumers.

13. Suspension and termination

Access to the Service may be suspended or terminated, in whole or in part, in the event of a breach of these Terms, at Discord Inc.'s request, or when the bot is removed from a Server by an Administrator.

You may stop using the Service at any time by removing the bot from your Servers and, for your account data, by using the deletion options available from the dashboard settings (see our Privacy Policy).

14. Changes to these Terms

These Terms may be amended at any time; the applicable version is the one published on this page, together with its last-updated date.

In the event of a material change, reasonable notice will be given (an announcement on the support server, a notification in the dashboard). Continuing to use the Service after a change constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

16. Governing law and disputes

These Terms are governed by French law.

In the event of a dispute, and failing an amicable resolution via the support server, the competent French courts shall have exclusive jurisdiction, subject to any mandatory consumer-protection provisions of your country of residence within the European Union.
